Knowing your rights as a healthcare patient empowers you to receive better care and make informed decisions. Federal and state laws protect these rights, though many people are not aware of them.

Informed Consent

You have the right to understand any proposed treatment, including its risks, benefits, and alternatives, before agreeing to it. Doctors must explain procedures in language you can understand. You can refuse any treatment, even if recommended.

Privacy Rights

The HIPAA law protects your medical information. Healthcare providers cannot share your information without your permission except in specific circumstances. You have the right to access your own medical records and request corrections to errors.

Emergency Care

Hospitals with emergency departments must provide screening and stabilization regardless of ability to pay. This federal law, called EMTALA, ensures access to emergency care for everyone.

Advance Directives

You have the right to make decisions about your future care through advance directives. A living will specifies your wishes for end-of-life care. A healthcare power of attorney designates someone to make decisions if you cannot.

If you feel your rights have been violated, speak with the facility’s patient advocate. You can file complaints with state health departments or the Office for Civil Rights. Do not hesitate to seek a second opinion or change providers if needed.
